JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 21-02-2018 Heard learned counsel for the petitioner and the counsel appearing on behalf of the State as well as University. Petitioner was appointed on compassionate ground. In the present writ application grievance of the petitioner is non-payment of salary since 2.3.2015.

The idea behind compassionate appointment is to provide financial assistance to the family of the person died in harness. In order to tide over the financial crisis, the petitioner was appointed on compassionate ground, the University was under obligation to see that the payments are made so that the objective of compassionate appointment is achieved. But unfortunately, contrary to the objective of compassionate appointment, petitioner was denied salary, as a result thereof,

Counsel for the petitioner submits that petitioner was paid salary after March 2017, however, from 2nd March 2015 to March 2017 nothing was paid to the petitioner and only after filing of the writ petition dated 25.1.2017, the University started making payment of salary to the petitioner.

Considering the peculiar fact and circumstance of the case, the respondent University is directed to see that admissible dues for the period 2nd March 2015 to March,2017 is paid to the petitioner within a maximum period of sixty days from the date of receipt/production of a copy of this order, failing which the arrears of salary will carry interest @ 9 per cent and interest component shall be borne out from the officers of the University and College responsible for delay in making payment to the petitioner .
