Petitioner claims that approach path of NH-83 as well as some part of street bearing Mouza Mohiuddinpur, Thana No. 77, Khata No. 113, Khesra No. 479 have been encroached by the private respondent.

It is submitted that he has represented vide Annexure-7 dated 15.07.2016 to the Anchal Adhikari, Phulwarisharif, Patna

Patna High Court CWJC No.14969 of 2016 dt.02-12-2016 but nothing has been done till date even after the direction of the Sub-divisional Officer, Patna Sadar.

Accordingly, let the Circle Officer immediately examine the matter and if it is found that there is any encroachment of public land or approach path then he would be required to take immediate action under the Bihar Public Land Encroachment Act and bring it to its logical conclusion on its own merit and in accordance with law within a period of three months from the date of receipt/production of a copy of this order after granting reasonable opportunity to all the concerned including the private respondents.

It is made clear that this Court has not expressed its opinion on the merits of the case.
