This application for grant of regular bail arises out of Special Case No. 142 of 2020 arising out of Araria Police Station Case No. 95 of 2000, disclosing offences punishable under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2016.

Allegedly, from the truck, which was being driven by the petitioner 3969 liters of Indian made foreign liquor was recovered. The petitioner is resident of State of Punjab and he was apprehended by the police at Araria.

Mr. Mrigank Mouli, learned counsel appearing on behalf of the petitioner has submitted that being driver of the vehicle, he was not aware of the presence of the illicit liquor in

Considering the huge quantity of illicit liquor alleged to have been recovered from the truck, the plea that the petitioner had no knowledge about the presence of illicit liquor in the said truck is not acceptable to this Court for the purpose of grant of regular bail.

This application is, accordingly, rejected.

The petitioner shall, however, be at liberty to renew his prayer for bail after six months, if there is no substantial progress in the trial, in the meanwhile.
