====================================================== CORAM: HONOURABLE JUSTICE SMT. SONI SHRIVASTAVA ORAL ORDER 25-07-2025 Heard learned counsel for the petitioner, learned APP for the State and learned counsel appearing for the Vigilance.

2. The petitioner apprehends her arrest in a case registered for the offences punishable under Sections 420, 467, 468, 471, 120B of the Indian Penal Code.

3. The allegation in the FIR is that the petitioner had secured her appointment as Panchayat Teacher in the year 2006 on the basis of fake and forged marksheet/certificate.

4. Learned counsel for the petitioner submits that the petitioner has been serving regularly since 2006 without any grievances from the school department, however, without proper verification, the petitioner is being penalised. It is further submitted that the petitioner has now resigned from the

Patna High Court CR. MISC. No.36898 of 2025(3) dt.25-07-2025 2/2 service and her resignation letter dated 28.06.2025 has been brought on record by way of Annexure-P/4 to the supplementary affidavit filed on behalf of the petitioner.

5. Learned APP for the State and learned counsel appearing for the Vigilance, however, oppose the prayer for anticipatory bail.

6. Considering the fact that the petitioner has already been terminated from the service, I am inclined to grant the privilege of anticipatory bail to the petitioner. Let the petitioner, above named, in the event of her arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned lower Court where the case is pending/successor Court in connection with Bihpur P.S. Case No. 35 of 2025, subject to the condition as laid down under Section 438 (2) of the Cr.P.C/ 482 (2) of the BNSS, 2023. (Soni Shrivastava, J) divyanshi/- U T
