The petitioners are apprehending their arrest in a case registered for the offence punishable under Sections 142, 143, 149, 147, 148, 323, 325, 307, 353, 435, 427 of the Indian Penal Code.

Learned counsel for the petitioners submit that the petitioners, who have clean antecedent, is innocent and have not committed any offence. In fact, the co-accused having more or less similar allegation has already been granted the anticipatory

Patna High Court CR. MISC. No.35865 of 2019(3) dt.13-08-2019 2/2 bail by a co-ordinate Bench of this Hon'ble Court in Cr. Misc. No. 32337 of 2019 on 16.05.2019 and in Cr. Misc. No. 35784 of 2019 on 10.06.2019 and the case of those petitioners stand on similar footing. Hence, the petitioners may be granted the privilege of anticipatory bail.

In the aforesaid facts and circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each in connection with Hathauri (Shivajeenagar O.P.) P.S. Case No. 16 of 2019 to the satisfaction of the learned Judicial Magistrate, 1st Class, Rosera, District-Samastipur, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
