====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 21-03-2022 The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

The accusation against the petitioner and others is of killing the husband of the informant.

It is submitted by learned counsel for the petitioner that petitioner was not named in the F.I.R and his name surfaced only on the basis of suspicion. From perusal of the case diary, it appears that petitioner was actively involved in the commission of murder of the husband of the informant. The case diary also reveals that a mobile phone was recovered near the dead

Patna High Court CR. MISC. No.35268 of 2020(7) dt.21-03-2022 2/2 body which was registered in the name of Sangita Devi who happens to be the mother of this petitioner and that mobile phone was being used by this petitioner. The charge-sheet has also been submitted against the petitioner showing the petitioner absconder and process under Sections 82 and 83 Cr.P.C has also been initiated against the petitioner. Considering the facts and circumstances of the case, this Court is not inclined to grant privilege of anticipatory bail to the petitioner.

The prayer for anticipatory bail of the petitioner stands rejected.
