2. The petitioner apprehends his arrest in a case registered for the offences punishable under Section 394 of the Indian Penal Code and section 27 of the Arms Act.

3. As per the prosecution case, on the alleged date and time of occurrence, while the informant was returning home after finishing his work from Gudia Gas Agency by CT-100 motorcycle having a bag containing laptop. In the way, three miscreants riding on a motorcycle fired upon the informant, as a result of which he sustained injury on his right thigh, thereafter, one of them snatched the bag, thereafter, all the three miscreants fled away.

4. It is submitted that petitioner is not named in the

Patna High Court CR. MISC. No.38170 of 2023(3) dt.11-08-2023 2/2 FIR. Name of petitioner transpired on the basis of confessional statement of co-accused Alimuddin Khan at the instance of local Mukhiya because the petitioner had made protest in the panchayat election. No stolen article has been recovered from possession of this petitioner. Petitioner is student and has been selected in Indian Postal Service on the post of Postal Assistant. Save and except confessional statement there is no material against this petitioner.

Considering the facts aforesaid, the petitioner above-named, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate VIIIth, Siwan in connection with Raghunathpur P.S. Case No. 21 of 2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
