Opposite Party/s ====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 02-05-2016 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 420, 504 and 506 of the Indian Penal Code.
Allegation against the petitioner is that he took Rs.6 lacs from the complainant on the promise of providing employment to his son and one relative. Both of them joined to their respective job but no salary was paid to them. Both demanded to return their money but same was not done.
It is submitted on behalf of the petitioner that he has got no criminal antecedent. The alleged date of occurrence is said to be 26.8.2011 and the complaint was filed on 15.11.2014. No explanation has been made in respect to the delay in filing the complaint. Petitioner is a Government employee. On behalf of the State, it is submitted that petitioner is named in the complaint.
Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of arrest or surrender in the
Patna High Court Cr.Misc. No.15484 of 2016 (2) dt.02-05-2016 2/2 court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of Shri J. K. Kashyap, learned Judicial Magistrate, Ist Class, Madheura, in connection with Complaint Case no. 1104 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
