JUSTICE DINESH KUMAR SINGH ORAL ORDER 31-07-2018 The matte has been listed under the heading 'To Be Mentioned, at the instance of learned counsel for the Railway for withdrawal of the present writ application. It is submitted by learned counsel for the Railway, that the notification with regard to empanelment of the counsels for the Railway which is under challenge in the present writ application has now been cancelled, hence, the present writ application has become infructuous. Statement to that effect has been made in paragraph no.5 of the supplementary counter affidavit filed on behalf of Respondent No.3, which reads as
Patna High Court CWJC No.10620 of 2015(2) dt.31-07-2018 2/2 follows:- "That it is stated that General Manager, East Central Railway, Hajipur has cancelled the notification dated 31.03.2015, 16.04.2015 and 07.03.2018 due to some unavoidable reasons. This information has been communicated to the Secretary, District Bar Association, Civil Court, Patna by Dy.CCM/Claims vide letter dated 17.04.2018."
The contention of learned counsel for the Railway has not been controverted by learned counsel for the petitioner. In the circumstances, the present writ application is dismissed as withdrawn.
