1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 118(1), 76, 303(2), 352, 351(2), 3(5) of the B.N.S., 2023.

Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and the informant alleges that a dispute relating to property had arisen in the family, as such jon 10.12.2025 at 2 P.M. Harinath (petitioner) started constructing a wall on his land, on objection, he abused, thereafter Pashupati also came and started abusing, thereafter Harinath assaulted her by farsha causing injury on head and both accused snatched her chain and also assaulted her husband.

4. Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant on account of dispute relating to land. It is next submitted that petitioner was constructing his boundary over his own land and the same was objected by the husband of the informant, on which, an altercation took place in which both side assaulted each other and the informant got pushed and thus received injury. It is also submitted that from perusal of the order impugned, it would manifest that the injury suffered by the injured has been opined to be simple in nature. It is reiterated and submitted that petitioner is a persons with clean antecedent.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

6. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Sakatpur P.S. Case No.134 of 2025, subject to the
