2. The petitioner has preferred this application for grant of regular bail in connection with Pipra P.S. Case No. 362 of 2024 dated 06.12.2024 registered for the offences punishable u/ss 309(4) and 317(2) of the B.N.S.
3. As per the prosecution case, while the informant was returning in his E-rickshaw, he was surrounded by three persons ridden on a motorcycle. One of the co-accused persons snatched the mobile phone of the informant and another coaccused snatched the key of his vehicle. Thereafter, local people caught the accused persons but one person managed to escape. The apprehended persons disclosed their name as Nitish Kumar and Golu Kumar (petitioner) and they also disclosed the name of the person who managed to flee away from the spot as Sandeep Kumar. On search, one stolen mobile was recovered from the possession of the petitioner. One mobile phone and Rs. 1000/- were recovered from the possession of the co-accused, Nitish Kumar.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner has been made accused in this case merely on suspicion. No incriminating article has been recovered from the conscious possession of the petitioner. The co-accused person has already been granted regular bail by a Coordinate Bench of this court vide order dated 16.04.2025 passed in Cr. Misc. No. 17947/2025. The petitioner has no concern with the alleged recovery. The petitioner has one criminal antecedent in which he is on bail as stated in para 3 of the bail petition. The petitioner is in custody since 21.12.2024.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Supaul in connection with Pipra P.S. Case No. 362 of 2024 with the condition :- (i) The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled.
