2. The petitioner apprehends arrest in a case instituted under Sections 274, 275, 317(5), 3(5) of the B.N.S. and Section 30(a) of the Bihar Prohibition and Excise Act.

3. There is recovery of 423 litres illicit liquor from the orchard and 5.625 litres Nepali liquor was recovered from the motorcycle parked in the orchard.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case merely on suspicion. Nothing has been recovered from conscious possession of the petitioner. Petitioner has no concern either with the seized illicit liquor, motorcycle or the orchard. Petitioner has no criminal antecedent and he undertakes to

5. Learned A.P.P. for the State submits that from the report of the S.P., Madhubani, it appears that the seized motorcycle belongs to Ram Bhajan Singh and petitioner is not the owner of the said motorcycle.

6. Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Court concerned in connection with Jaynagar P.S. Case No.220 of 2024 corresponding to G.R. No.1082 of 2024, subject to the conditions as laid down under Section 482 (2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
