JUSTICE ASHUTOSH KUMAR ORAL ORDER 20-02-2021 Heard Mr. Manish Kumar No. 2, learned counsel for the petitioner and learned APP for the State. The petitioner seeks bail in connection with Sessions Trial No. 79 of 2020, arising out of Tekari P. S. Case No. 37 of 2019, instituted for offences under Section 387 of the Indian Penal Code and Sections 16B and 17 of the UAP Act.

The petitioner has not been named in the F.I.R. but his implication in this case is on the basis of confession of an arrested accused person. The petitioner was arrested in connection with Alipur P. S. Case No.

Patna High Court CR. MISC. No.34616 of 2020(3) dt.20-02-2021 2/3 19 of 2019 but subsequently he has been remanded in the present case.

In this case, the petitioner is in custody since 29.05.2019.

Mr. Manish Kumar No. 2, learned counsel for the petitioner has submitted that there has been no progress in this case before the court below. Though the petitioner is said to have been made accused in 10 other cases but he has been acquitted in three cases and is on bail in almost all other cases.

Considering the afore-stated facts and the period of custody of the petitioner, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge, VI, Gaya, in connection with Sessions Trial No. 79 of 2020, arising out of Tekari P. S. Case No. 37 of 2019.
