The Court in its order dated 10.01.2017 has recorded in detail the lis before the Court. However, before the parties could address the Court on merits, learned counsel for the contesting respondents no. 3 and 4 agrees to get the writ petition disposed off confirming the interim stay order so that the main Surcharge Appeal
Patna High Court CWJC No.170 of 2017 dt.08-02-2017 2/2 Case No. 07 of 2016 itself may be disposed off expeditiously. Learned counsel for the petitioners agrees to the said proposal.
In view of the aforesaid, the writ petition stands disposed off by setting aside the order dated 15.12.2016, contained in Memo No. 171/ML, in Surcharge Appeal Case No. 07 of 2016 passed by the Appellate Authority. The parties are directed to cooperate so that the matter itself is finally disposed off within a period of two months. The parties, who are before the Court, shall appear before the Appellate Authority on the next date fixed, which is 21st February, 2017, and thereafter cooperate in disposal of the matter.
