The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 30(a), 41(1), 41(2) of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that there is no recovery from the conscious possession of the petitioner. It is further submitted that similarly co-accused have been granted the privilege of anticipatory bail by a coordinate Bench of this Court in Cr. Misc. No. 36702 of 2019 on 25.06.2019.
