JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 23-11-2021 Heard learned counsel for the petitioner and the State. The petitioner prays for grant of regular bail in a case registered for the offence punishable under section 302 and other ancillary sections of the Indian Penal Code and section 13 and other sections of Anti Legal Activity Act. As per the prosecution case, this petitioner and other accused persons caused death of informant's uncle. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case due to land dispute between the parties. There is no eye witness of the occurrence and Balistar yadav who was with the deceased at the time of occurrence, has not disclosed the name of the petitioner. Patna High Court CR. MISC. No.47063 of 2021(3) dt.23-11-2021 2/2 been allowed bail by a co-ordinate bench of this Court vide order passed in Cr.Misc.No. 32902/2017. He is in custody since 19.2.2021.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Rohtas at Sasaram in Nauhatta Police Station Case No. 101 of 2016.
