The petitioner has renewed his prayer for bail in a case registered under sections 366A and 34 of the Indian Penal Code.

As per the prosecution case, the petitioner who is a tempo driver along with one another accused are said to have kidnapped the minor daughter of the informant with the intention of marriage.

It is submitted by learned counsel for the petitioner that the earlier prayer for bail of the petitioner was rejected vide order dated 20.1.2021 (Annexure-1) passed in Cr. Misc. no. 35180 of 2020 wherein learned trial Court was directed to expedite the trial. The petitioner is in custody since 16.3.2018

Patna High Court CR. MISC. No.37927 of 2022(3) dt.31-08-2022 2/2 and there is no chance of the trial concluding in the near future. The prayer for bail is opposed by learned AP.P for the State.

Having heard learned counsel for the parties and taking into consideration the materials on record, it transpires that the allegation against the petitioner is of having committed rape on the 13 year old minor daughter of the informant which has been supported by the minor victim in her deposition in course of the trial.

In the facts of the case, the Court is not inclined to enlarge the petitioner on bail and the application is rejected. (Partha Sarthy, J) Prakash/- U
