Patna High Court CWJC No.11172 of 2013 (3) dt.23-09-2016 Gone through the order impugned in consonance with paragraph 8 of the plaint as well as paragraph 3 of the proposed amendment relating to paragraph 8 of the plaint. Further plain reading of the same, it is apparent that whatever been pleaded in paragraph 8 is being supplemented by such proposed amendment thereupon the learned lower court ought to have allowed the same. Accordingly, order impugned relating to rejection of paragraph 3 of the proposed amendment is set aside.

Accordingly, the petition is allowed.
