The petitioners apprehend their arrest in connection with Tajpur (Halai) P.S. Case No. 85 of 2019 registered under Sections 30(a), 41(1), 41(2) of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioners submits that petitioners are innocent and have falsely been implicated in the present case due to enmity and grudge. On perusal of Seizure List, it appears that nothing has been recovered from the possession of the petitioners. Further submission is that petitioners are not the owner of the seized

Patna High Court CR. MISC. No.36702 of 2019(2) dt.25-06-2019 2/2 Truck and they have no concern with the seized materials. Having considered the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II-cum-Special Judge, Excise Act, Samastipur in connection with Tajpur (Halai) P.S. Case No. 85 of 2019, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
