The present modification application has been filed for modification of order dated 19.07.2017 passed in C.W.J.C. No. 9744

Patna High Court MJC No.2619 of 2018(11) dt.15-09-2021 2/2 of 2011 (Sweta Kumari versus The State of Bihar and Ors.) by which the writ petition was disposed of giving liberty to the petitioner to file an appeal before the State Appellate Authority within a period of thirty days from the date of order.

Learned counsel for the petitioner submits that the petitioner came to know about the said order belatedly due to the communication gap and seeks for extension of thirty days time for filing an appeal before the State Appellate Authority, Patna. The present application was filed as back as in the year 2018.

Considering the grounds stated in paragraph Nos. 3 to 5 of the modification application and the submissions made in the support thereof, the modification application is allowed. The petitioner shall file an appeal before the State Appellate Authority within a period of thirty days from the date of this order. The order dated 19.07.2017 passed in C.W.J.C. No. 9744 of 2011 is modified to the extent as indicated above. (Sudhir Singh, J) Pankaj/- U
