The petitioner apprehends his arrest in connection with Bagaha (Mahila) P.S. Case No.32 of 2022, registered for the offence punishable under section 376 of the Indian Penal Code. The allegation against the petitioner is that he physically exploited the informant on the pretext of marriage. It is also alleged that the petitioner has abused and assaulted the informant and refused to marry her and also threatened to kill her.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and have committed no offence. He has been falsely implicated in this case. No such occurrence, in the manner as alleged, has ever taken place. He submits that the

No.37990 of 2022(7) dt.14-02-2023 2/2 victim girl is a major and there is no date mentioned in the FIR to show as to when the petitioner committed physical assault with the informant. He relied upon the judgment of Apex Court in Cr. App 1443 of 2018 (arising out of SLP (Criminal) No.6532 of 2018). Petitioner has no criminal antecedent. Learned APP for the State opposed the prayer for anticipatory bail and submits that the victim is a minor and has supported the prosecution case in her statement recorded u/s 164 Cr.PC.

Having regard to the facts and circumstances of the case, I am not inclined to enlarge the petitioner on bail. The prayer for grant of anticipatory bail on his behalf is hereby rejected. Accordingly, this application is dismissed.
