====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 29-06-2022 Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 406, 409 and 420 of the Indian Penal Code.

Learned counsel for the petitioners submits that the petitioners are persons with clean antecedent and the informant alleges that all the accused persons were elected members of concerned Panchayat, Baliyadih and its Ward No. 10, 12 and 14

Patna High Court CR. MISC. No.48424 of 2021(3) dt.29-06-2022 2/3 and officials also have committed irregularity while discharging their duty/work for Sat Nischay Yojna of the government and while doing work of Nal-Jal, Gali-Nali Yojna and misappropriated the public money.

Learned counsel for the petitioners further submits that similarly situated co-accused Jai Prakash Yadav has been granted anticipatory bail by order dated 14.12.2021 in Cr. Misc. No. 48197 of 2021 and Babita Dev has been granted anticipatory bail by order dated 10.02.2022 in Cr. Misc. No. 43184 of 2021, thus, seeks anticipatory bail on parity. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

Considering the submissions made by the learned counsel for the petitioners and the nature of allegation as alleged in the FIR and the fact that co-accused have been granted anticipatory bail, the petitioners above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Jhajha P.S. Case No.

Patna High Court CR. MISC. No.48424 of 2021(3) dt.29-06-2022 3/3 176 of 2020, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
