Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual mode.

The petitioner seeks regular bail in connection with Nathnagar P.S. Case No. 197 of 2022, lodged under Sections 307 & 328 of the Indian Penal Code.

As per the prosecution case, the informant has narrated story that on the occasion of Holi, he has purchased English wine from the shop of petitioner, after drinking the same he lost his eye sight and presently under treatment. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. He further submits that there is no question of selling of English wine as

Patna High Court CR. MISC. No.38038 of 2022(2) dt.30-09-2022 2/2 selling of wine is completely ban in Bihar. He further submits that petitioner is a man of clean antecedent and is in custody since 29.03.2022, charge sheet has already been filed in this case.

Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Nathnagar P.S. Case No. 197 of 2022, subject to the conditions as laid down under Section 437(3) of Cr.P.C. with other following conditions:
