The petitioner, who had retired as Panchayat Secretary, Ramgarh Block District-Kaimur, claims that he did not get his benefit of first and second ACP for which he was entitled in view of the decision of the State Government dated 18.05.2009 (Annexure-1) and he was also not given his salary since June, 2011 in view of the fact that his Last Pay Certificate was not sent by the Block Development Officer, Durgawati to the Block Supply Officer, Ramgarh. Accordingly, this writ application is being disposed of with a direction to the respondent no.2, the District Magistrate, Kaimur at Bhabua to ensure that Last Pay Certificate of the petitioner is sent by the Block Development Officer, Durgawati to the Block

Patna High Court CWJC No.802 of 2017 dt.30-01-2017 2/2 Development Officer, Ramgarh and, thereafter, ensure that the petitioner's salary is paid within a period of three months from the date of receipt/production of a copy of this order and also if the petitioner is found entitled then the benefit of first and second ACP should also be given to him after duly examining the matter. However, if the petitioner is not found entitle for the aforesaid benefit and claim then a reasoned order would be required to be passed by the District Magistrate which should be communicated immediately to the petitioner.
