The petitioner seeks bail in connection with Majorganj P. S. Case No. 217 of 2019, dated 13.12.2019, instituted for offences under Sections 8/20(b), (ii)(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985.

There is a recovery of 1.480 kg. of charas from the petitioner.

He is in custody since 14.12.2019.

On 22.02.2021, this Court had called for a

Patna High Court CR. MISC. No.34563 of 2020(4) dt.17-03-2021 2/2 report from the court below about the stage of case. The report dated 02.03.2021 indicates that the case is still pending for supply of police papers to the accused.

This does not appear to be an encouraging situation.

Though this Court is not inclined to grant bail to the petitioner for the present but directs the court below to conclude the trial positively within a period of nine months, failing which the petitioner shall have the liberty to approach the court below for grant of bail and in that event, the court below shall be under an obligation to record the reasons for the tardy progress of the trial. The petition stands dismissed with the liberty aforesaid.
