The petitioners apprehend their arrest in Buniyadganj P.S. Case No. 197 of 2015 registered for the offences punishable under Sections 302 and 34 of the Indian Penal Code. The informant widow of the deceased made allegation that on account of land dispute, the petitioners and other family members of her husband burnt her husband on 14.05.2015, and during course of treatment her husband died.

Learned counsel for the petitioners submits that the petitioners are family members of the deceased but from perusal of the order of the learned Sessions Judge, it appears that the Dy. S.P. directed the investigating officer to submit final form finding the

Patna High Court Cr.Misc. No.11168 of 2016 (5) dt.21-09-2016 2/2 case of mistake of facts.

In this view of the fact, the petitioners have got no apprehension of being arrested. Accordingly, the anticipatory bail petition is dismissed.
