JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 18-03-2016 Heard learned counsel for the petitioners and learned counsel for the State.
The petitioners seek pre-arrest bail in connection with Dinara (Bhanas) P.S. Case No. 271 of 2015 dated 05.08.2015 registered under Sections 147, 149, 427 and 379 of the Indian Penal Code.
It is contended that four other co-accused persons namely, Mod Narayan Singh @ Mod Narayan, Ram Parikha Singh, Arbind Singh @ Arvind Kumar Singh and Jaipati Singh
Patna High Court Cr.Misc. No.12147 of 2016 (2) dt.18-03-2016 2/2 against whom there is identical allegation to that of the petitioners have already been granted pre-arrest bail vide order dated 12.02.2016 passed in Criminal Misc. No. 6656 of 2016. Learned counsel for the State opposes the application for grant of pre-arrest bail. However, he concedes that the case of the petitioners is identical to that of the other coaccused persons, who have already been granted anticipatory bail. Regard being had to the nature of the offence as also the facts and circumstances of the case, in the event of arrest or surrender in the court below within a period of six weeks, the petitioners, above named, are directed to be released on bail on furnishing a bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Bikramganj, Rohtas in connection with Dinara (Bhanas) P. S. Case No. 271 of 2015 subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
