JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 11-07-2023 Heard learned counsel for the petitioner and the State. Petitioners apprehend their arrest in a case registered for the offence punishable under Sections 498A of the Indian Penal Code and Section 3 & 4 of Dowry Prohibition Act. As per the prosecution case, petitioner along with other family members committed torture on the complainant due to non-fulfilment of dowry demand.

Petitioner is the dewar of the complainant.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. It is further submitted that the petitioner is separate in

Patna High Court CR. MISC. No.37873 of 2023(2) dt.11-07-2023 2/2 mess and business. Thrust of allegation is against the husband of the complainant who has already been granted bail. Learned counsel for the State opposed the prayer for pre-arrest bail of the petitioner.

Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Addl. Chief Judicial Magistrate, Barh, Patna in connection with Complaint Case No. 417 of 2022 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
