Heard learned counsels for the petitioner, informant and learned A.P.P. for the State through Virtual mode. The petitioner is apprehending her arrest in a case for the offence registered under Sections 302/34 of the I.P.C. The prosecution story, in brief, is that on 08.08.2020 at about 6.15 P.M. co-accused Anmol Thakur, Sitaram Thakur and Shila Devi (petitioner) came on her door and started abusing. Her father Krishna Mohan Thakur protested then on

No.35264 of 2020(2) dt.09-04-2021 2/3 the order of co-accused Sitaram Thakur, co-accused Anmol Thakur assaulted her father with Khanti on his head and he fell down on the ground. This petitioner and her mother also assaulted the father of the informant. Her father was admitted in the hospital where he died.
It has been submitted by learned counsel for the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. The petitioner is a lady. No deadly weapon is said to have been used in course of occurrence. The main allegation is against co-accused Anmol Thakur On behalf of the learned counsels for the State and the informant, it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances of the case, let the petitioner above named, in the event of arrest or surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) only with two sureties of the like amount each to the satisfaction of the learned C.J.M. Samastipur, in connection with Warisnagar P.S.
