The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 342, 323 and 307 and 379 of the Indian Penal Code. On protest being made by the informant's side when the accused persons were filling soil on the land of the informant, the petitioner no. 2 Quamaruzzaman Khan assaulted the informant with Farsa, petitioner no. 1 Sabir Khan assaulted with Farsa on the palm of the informant when the father, brother and wife of the informant came to rescue they were also assaulted. Only one injury of the wife of the informant has been found to be grievous

Patna High Court Cr.Misc. No.9798 of 2015 (2) dt.11-03-2015 2 / 2 which has been caused by co-accused Fakharu Jawa Khan(non-petitioner). The injury of the informant has been found to be simple. There is counter version of occurrence also and several persons from the petitioners' side have also received injury. A statement has been made in paragraph no. 3 of the petition that the petitioners have no criminal antecedent.

Considering the aforesaid facts, let the petitioners, above named, be released on bail in the event of arrest or surrender before the learned court below within a period of twelve weeks from today in connection with Chautarwa P.S. Case No. 220 of 2014 on furnishing bail bond of Rs.10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M. Bagaha, West Champaran, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
