====================================================== CORAM: HONOURABLE MR. JUSTICE GOPAL PRASAD ORAL ORDER 11-05-2015 Heard learned counsel for the petitioner, the State and the informant.

This is a petition for grant of anticipatory bail in a case under Section 498A of the Indian Penal Code as well as Section 3⁄4 of the Dowry Prohibition Act.

There is allegation of demand of dowry and on non-fulfilment of the same, subjecting to cruelty. The petitioner is husband of the informant.

Learned counsel for the petitioner submits that the petitioner is not ready to keep the informant. Learned counsel for the informant submits that the informant is also not ready to live with the petitioner.

Patna High Court Cr.Misc. No.29757 of 2014 (5) dt.11-05-2015 Hence, having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on anticipatory bail in the event of his arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class, Gaya in connection with Guraru P.S. Case No. 35 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr. P. C. as well as the petitioner shall pay maintenance worth Rs.1,500/- per month in any account given by the informant till any higher maintenance is fixed by the competent Court. Further the petitioner shall appear in the case on each and every date fixed by the Court below for early disposal of the case.
