JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 03-07-2023 Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner is seeking regular bail in connection with Amas P.S. Case No. 426 of 2022, registered for offence punishable under sections 386, 387 and 34 of the Indian Penal Code.

As per allegation, six accused persons on two motorcycles came to the fly ash factory of the informant. They assaulted the informant and his labourers and also snatched a mobile set from one labourer of the informant. The learned counsel for the petitioner has submitted that the petitioner is not named in the FIR, nothing was recovered from his possession and on exactly similar footing,

Patna High Court CR. MISC. No.37673 of 2023(2) dt.03-07-2023 2/2 co-accused Kamlesh Kumar Yadav has been granted bail by a coordinate Bench of this Court in Cr. Misc. No. 17660 of 2023. He has submitted further that the petitioner was not put on T.I.P. and he is under custody since 31.10.2022.

Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand rupees) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Sherghati, Gaya in connection with Amas P.S. Case No. 426 of 2022, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.

(ii) If the petitioner is found involved in future in the similar type of offence, his bail bond shall be liable to be cancelled.
