The petitioner seeks bail in Bagen Gola P.S. case No. 72/ 2020 registered u/s 147, 148, 149, 341, 323, 307, 379, 504 of the IPC and u/s 27 of the Arms Act.
The informant, Lalaji Singh, alleged that while he was going to bring fodder he saw that petitioner and others were cutting the ridge of his pond. When the informant forbade, Nawmi Singh abused and instigated. On such, Rajesh Singh assaulted the informant with Farsa on his head. When Satan Singh, brother of the informant, came to save Sonu Singh, the petitioner, and Raushan Singh are alleged to have assaulted Satan Singh with iron rod and Lathi. It is further alleged that when Vikash Singh and Diwan Singh, nephew of the informant, came to save, Manu Singh opened fire but the firing did not hit

The learned counsel for the petitioner submits that petitioner is assailant of Satan Singh. There is counter version and from perusal of injury report of Satan Singh- Annexure-2, it would appear that Satan Singh got one lacerated wound, body ache and pain in shoulder. The doctor opined the injuries to be simple in nature. The petitioner is in custody since 05.06.2020. Considering the facts aforesaid and the nature of allegation made against the petitioner and the fact that on account of assault made by the petitioner simple injury is said to have been cause, the petitioner, above named, is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate I, Buxar in connection with Bagen Gola P.S. case No. 72 of 2020.
