2. Petitioner seeks regular bail in connection with Marhowrah PS Case No. 684/2020 registered for the offence punishable under Sections 457, 380, 411 of the IPC.

3. The allegation, as per First Information Report, is that a stolen suitcase has been recovered from the possession of the petitioner and others and two Sarees, Petticoat and bangles have been recovered from the said suitcase.

4. Learned counsel for the petitioner submits that the petitioner has not committed any offence of theft in the manner alleged in the FIR and he is in custody since 01.08.2020 and he is a student of Rejendra College, Saran at Chapra studying in

Patna High Court CR. MISC. No.35255 of 2020(3) dt.18-01-2021 2/2 BA Part-II. Learned counsel further submits that charge-sheet has already been submitted in this case and there is no apprehension that petitioner will abscond or tamper with the evidence if he is released on bail.

Having regard to the submissions made by the parties and taking into consideration the material on record and the fact that petitioner has got no criminal antecedent, he is in custody since 01.08.2020, charge-sheet has already been submitted in this case and there is no apprehension that petitioner will abscond or tamper with the evidence, I am inclined to grant regular bail to the petitioner.

6. Accordingly, let the petitioner, GOLU KUMAR be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra in connection with Marhowrah PS Case No. 684/2020.

7. It is made clear that at the time of furnishing bail bonds all the parties shall follow the guidelines of social distancing.
