Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual mode.
The petitioner seeks regular bail in connection with Town (Hajipur) P.S. Case No. 173 of 2022, lodged under Section 414 of the Indian Penal Code read with Sections 25 (1b)a, 26, 35 of the Arms Act. As per prosecution, the case has been filed against 2 named accused persons including the present petitioner. Upon raid by the Police, the recovery of Desi Katta alongwith one live cartridge have been made from the possession of petitioner. Learned counsel for the petitioner submits that petitioner is in custody since 28.02.2022, having clean
Patna High Court CR. MISC. No.38124 of 2022(2) dt.23-09-2022 2/2 antecedent. Learned counsel for the petitioner further submits that petitioner is ready to fulfill all the conditions whatsoever shall be imposed upon him by the Court.
Learned counsel for the State opposes the prayer for bail.
In the present facts and circumstances of this case and the submissions made above, I am not inclined to grant bail to the petitioner at present, but liberty is hereby granted that he may renew his prayer for bail after four months from the date of passing of this order, and upon move for bail the Trial Court shall release the petitioner on bail imposing its own conditions, so that he may not evade his appearance during trial. With this observation, the bail application stands rejected.
