1. Heard learned counsel for the parties.
2. The petitioner has preferred this application for grant of regular bail in connection with Excise Sherghati P.S. Case no. 120 of 2025 registered under sections 30(a) and 32(3) of the Bihar Prohibition and Excise Act, 2016.
3. As per the prosecution case, 21.75 litres of IMFL was recovered from the motorcycle being driven by the petitioner and he was taken into custody.
4. Learned counsel for the petitioner submits that no incriminating article has been recovered either from the possession of the petitioner or from his motorcycle. He has been falsely implicated in the case. He is in custody since 13.4.2025 and undertakes to cooperate in the investigation/trial.

Patna High Court CR. MISC. No.35411 of 2025(2) dt.11-06-2025 2/2 A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the allegations in the F.I.R. together with the petitioner having remained in custody since 13.4.2025 and especially the petitioner not having any antecedent under the Bihar Prohibition and Excise Act, 2016, the petitioner is directed to be enlarged on bail in connection with Excise Sherghati P.S. Case no.120 of 2025 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Excise Court No.3, Gaya.
