The petitioner apprehends his arrest in Araria P.S. Case No.717 of 2018 registered under Sections 341, 323, 325, 379 and 34 of the Indian Penal Code.

The informant alleged that while he was going to his house after visiting Durga Puja and when he reached near Bus Stand Nahar bridge, Nitish Kumar Jha, Karan Kumar(the petitioner) and Akshay Kumar surrounded him and assaulted the informant. Nitish Kumar Jha gave a punch on his mouth causing uprootment of tooth. The accused persons assaulted him with fists and slaps.

The learned counsel for the petitioner submits that all the allegations are false and concocted. Nitish Kumar Jha has already been granted anticipatory bail by a co-ordinate Bench of

Patna High Court CR. MISC. No.35356 of 2020(4) dt.29-06-2021 2/2 this Court vide order dated 09.01.2020 passed in Cr. Misc. No.62620 of 2019. Akshay Kumar was granted anticipatory bail by the learned Sessions Judge vide order passed in A.B.P. No.1931 of 2018. The case of the petitioner stands on the same footing. The informant got simple injury.

Taking into consideration the facts that specific allegation of assault is made against Nitish Kumar Jha that he gave punch on his mouth but Nitish Kumar Jha has already been granted anticipatory bail by a co-ordinate Bench of this Court, Akshay Kumar has also been granted anticipatory bail by the learned Sessions Judge and the case of the petitioner stands on the same footing, let the petitioner, above named, in the event of his arrest or surrender within a period of four weeks be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Araria in connection with Araria P.S. Case No.717 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J) Saurabh/- U T
