JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 14-08-2019 Heard learned counsel for the petitioner, learned counsel for the State and perused the case diary. Petitioner apprehends her arrest in a case registered for the offence punishable under Sections 302, 120B/34 of the Indian Penal Code.

The informant alleges that the accused persons arrived at her house and assaulted her husband Suraj Sahani as a result of which he died. Petitioner has been alleged to have pressed the neck of informant's son Anil Kumar, whereas accused Singeshwar Sahani is alleged to have repeatedly inflicted knife blow on the victim.

Learned counsel for the petitioner submits that the allegation of knife blow is on the other accused person. Petitioner has got no criminal antecedent. Further, the deceased and father of the petitioner are full brothers and they are

Considering the facts of the case, let the petitioner, above named, in the event of her arrest/surrender before the Court below within a period of six weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate 1st Class, Muzaffarpur in Baruraj Police Station Case No. 314 of 2018, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully co-operate with the investigation and trial of the case, failing which the Court below shall be at liberty to cancel the bail bond of the petitioner.
