JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 12-02-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Mohiuddin Nagar P.S. Case No. 186 of 2013 registered for the offences punishable under Sections 147, 148, 142, 323, 324, 307, 380 of the Indian Penal Code.
The accusation against the petitioner no. 1 is that he gave one farsa blow on the head of injured Vibha Devi whereas accusation against petitioners no. 2 and 3 is that they committed theft in the house of the informant. The injured, Vibha Devi sustained simple injury, said to be caused by hard and blunt substance and so far as another injured, Rajendra Sahni is
Patna High Court Cr.Misc. No.5753 of 2015 (2) dt.12-02-2015 concerned, he was assaulted by co-accused, Ram Babu Sahni who is not petitioner here.
Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioners, in the event of their arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Samastipur in Mohiuddin Nagar P.S. Case No. 186 of 2013 subject to condition as laid down under Section 438(2) of the Cr.P.C.
