2. Petitioner apprehends arrest in a case registered for the offence punishable under section 420, 406, 468 , 471 and 34 of the Indian Penal Code .

As per the prosecution case , informant namely shyam kumar wanted to be partner in the gas agency of this petitioner for which he invested Rs. 16,00,000/- and transferred the same in Account No. 50200003675443 through Bank of India with a promise to get 50 share in the business. When informant wanted to register agreement, then petitioner neither registered it nor returned the aforesaid money of informant and as such this petitioner committed fraud with informant.
4. Learned counsel for the petitioner submits that
Patna High Court CR. MISC. No.48038 of 2024(4) dt.30-07-2025 2/3 petitioner is innocent and has committed no offence as alleged. As a matter of fact, at the relevant time, petitioner was in Ranchi for mental treatment and taking advantage of the same, informant prepared forged agreement on 01.01.2021, after stealing several cheques, stamp paper duly signed by this petitioner and other document from the Gas Agency namely Kanti Bharat Gas Gramin Vitrak Katharai. It is further submitted that petitioner issued show cause notice letter no. 05 of 2021 dated 31.05.201 and Letter No. 06 of 2021 dated 20.06.2021 to informant for committing fraud in Gas Agency i. e ,. AnnexureP/5 and in this regard petitioner also lodged informatory petition for stealing several cheques and stamp paper against the informant to Kochas Police Station vide Sanha No. 55 of 2021 duly signed by petitioner on 05.07.2021.

Learned counsel for the State opposes the prayer for bail and submits that there is direct and specific allegation against the petitioner that after receiving sum of Rs. 16,00,000/- in account from informant, he neither registered the agreement of 50% share of the agency nor returned the aforesaid amount to informant and as such, petitioner committed forgery and caused monetary loss to the informant.
6. Considering the materials available on record,
