This Modification Petition has been filed for modification of order dated 18-12-2012 passed by a coordinate bench of this court in Cr. Misc. No. 45400 of 2012. The petitioner was granted privilege of anticipatory bail by order dated 18-12-2012 passed by a coordinate bench of this court in Cr. Misc. No. 45400 of 2012 with direction to him to surrender before the learned Chief Judicial Magistrate, Gaya within a period of six weeks in connection with Excise Case No. 145 of 2010 but submission on behalf of the petitioner is that due to ailment, he could not surrender before the court below in time, as fixed by coordinate bench of this court and accordingly, a prayer has been made for extension of time to surrender in the court below.
