Petitioners apprehend their arrest in connection with Kochadhaman P. S. case no. 122/2014 registered under section 7 of the Essential Commodities Act.

Petitioner no.1 is PDS dealer and admittedly, after seizure of food grains, shop of the petitioner was searched and no shortage was found in the shop of this petitioner.

So far as petitioner no.2 is concerned, he is said to be driver of concerned pick-up van. Moreover, one Md Gulzar has claimed himself to be owner of the seized food grains and has already filed release petition before the court below.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that in the event of arrest/ surrender within four
