JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 06-07-2022 Heard the learned counsel for the petitioners as well as Mr. Jharkhandi Upadhyay, the learned Additional Public Prosecutor for the State.
The learned counsel for the petitioners wants to withdraw this criminal miscellaneous petition, as the Investigating Authorities recommended for Final Form. In view of above submission, this petition is dismissed as withdrawn.
So far as the show cause to S.H.O. of Piprahi Police Station is concerned, the learned Additional Public Prosecutor
Patna High Court CR. MISC. No.47334 of 2021(8) dt.06-07-2022 2/2 has submitted that in paragraph 2 of the show cause submitted by the S.H.O. it has been mentioned that the order dated 03.03.2022 was received in the court below on 23.03.2022 and the I.O. of this case arrested the one of the petitioners on 22.03.2022 and on that day, no information was given to the S.H.O. or I.O. of the said police station.
As the order dated 03.03.2022 was not communicated to the S.H.O., it was the reason that he arrested one of the petitioners on 22.03.2022.
The show cause submitted by the I.O. is accepted. The matter need not be listed.
