In the present case, petitioner is challenging the order of transfer.

Learned counsel for the State submits that District Appellate Tribunal is functioning.

In such view of the matter, petitioner is directed to file an appeal before the District Appellate Tribunal Saharsa. If the appeal is filed within four weeks from today the District

Patna High Court CWJC No.882 of 2017 (3) dt.05-09-2017 Appellate Tribunal Saharsa will decide the case in accordance with law. While disposing of the limitation matter the authority will take into account the pendency of the present case before this Court.

With the aforesaid observation and direction this writ petition is disposed of.
