Petitioners apprehend arrest in a case registered for the offence punishable under Sections 302, 201/34 of Indian Penal Code.

As per FIR, on 26.03.2022 at about 1:40 pm, informant received telephonic call that her daughter has died and requested to reach immediately. Informant suspects that all the FIR named accused persons including these petitioners committed murder of the daughter of the informant. Petitioner No. 1 is Bhagina of the husband of the deceased and petitioner No. 2 is mother-in-law. Learned counsel appearing for the petitioners submits

Patna High Court CR. MISC. No.38377 of 2022(2) dt.22-11-2022 2/2 that petitioners are innocent and have falsely been implicated in this case. It is submitted that both the petitioners are separate in mess and property and they have got no concern with the affairs of the couple. It is further submitted that specific allegation of assault and torture is against husband of the deceased and he is already in custody. Allegation against these petitioners is general and omnibus and they have been made accused in the instant case only on the basis of suspicion. Petitioners have got clean antecedent.

Considering the aforesaid facts and circumstances, let the above named petitioners in the event of their arrest/surrender before the court below within a period of thirty days from the date of receipt/production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-I, Danapur, Patna in Bihta P. S. Case No. 294 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) navya/- U T
