JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 20-01-2015 Heard learned counsel for the petitioners and learned counsel representing the State.

Petitioners apprehend their arrest in connection with Kanti P.S. Case No. 230 of 2014 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 504, 379, 384, 386, 387 of the Indian Penal Code and Section 27 of the Arms Act.

Allegedly, the petitioners and other FIR named accused persons being armed came in the Lichi orchard of the informant which he has taken on rent and they took away 50 packets of Lichi and also took out Rs. 25,000/- from the pocket of

Patna High Court Cr.Misc. No.30190 of 2014 (2) dt.20-01-2015 the informant and after making firing they fled away. Submission is of false implication and further the land is in dispute and a title suit is going on. Smt. Meera Devi has purchased the land from Sri Ratnesh Singh but this case has been lodged only with a view to put pressure.

Learned APP fairly submits that title suit is going on over the land described in the FIR.

In the facts and circumstances stated above, the petitioners above named, in case of their surrender or arrest within two months from the date of receipt/production of a copy of this order, shall be released on bail on execution of bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., West Muzaffarpur in connection with Kanti P.S. Case No. 230 of 2014, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Jitendra Mohan Sharma, J) avin/- U T
