2. The petitioner seeks bail in connection with G.B. Nagar P.S. Case No. 04 of 2025 registered for the offence under Sections 80(2), 3(5) of the BNS, 2023.

3. As per the prosecution case, the petitioner is the husband of the deceased and he is said to have killed the deceased.

4. The petitioner is in jail since 24.01.2025.

5. It has been submitted by the learned counsel for the petitioner that the deceased has committed suicide and the petitioner has falsely been implicated in this case. He further submits that two children have also been born out of the wedlock and out of the two children, one child is presently

6. Considering the facts of the case and also considering the totality of the circumstances, this application is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-IV, Siwan/concerned Court below in connection with G.B. Nagar P.S. Case No. 4 of 2025.

8. As a condition of this order, the Court below, before accepting the bail bonds of the petitioner, will verify the fact of one child staying with the family of the petitioner or not. It is made clear that the bail bonds of the petitioner shall only be accepted if one child is staying with the family of the petitioner. (Sandeep Kumar, J) Vikas/- U
