The petitioner apprehends his arrest in connection with Motipur P.S. Case No. 18 of 2019, registered under Section 304 of the Indian Penal Code, pending in the court of S.D.J.M., West, Muzaffarpur.
The accusation is that petitioner, who is co-villager of informant, Md. Habib, had surrounded his filed by electric wire and he used to put the electric current in the night. In spite of repeated protest by the villagers, petitioner used to connect the electric wire in the boundary of his filed. In the morning of 07.01.2019, his mother Tetra Khatoon had gone to her field to look potato crop but she did not return. When search was made
Patna High Court CR. MISC. No.36173 of 2019(3) dt.23-07-2019 2/2 then at about 8 P.M., his mother was found dead near the field of petitioner, which was surrounded by the electric wire. Her mother died due to short-circuit on touching wire surrounded the field of the petitioner.
Having considered the facts and circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, his prayer for grant of anticipatory bail stands rejected. The petitioner is directed to surrender before the trial court within four weeks and pray for regular bail, which would be considered by the trial court in accordance with law without being prejudiced by the order of this Court.
