2. This application has been filed by the Managing Committee of Kameshwar Harijan Kanya Madhya Vidyalaya, Nauhatta through its Secretary.

3. This application has been filed for a direction to the respondents to take decision on the question of taking over of the said School by the State Government. It is the case of the petitioner that the School in question is already included in the list of 390 non-Government Primary Schools.

4. Learned counsel appearing on behalf of the State of Bihar, resisting the prayer, has submitted that the State

Patna High Court CWJC No.1693 of 2017(2) dt.02-01-2018 2/2 Government of Bihar has taken a policy decision not to take over any privately managed Schools.

5. Learned counsel appearing on behalf of the petitioner has, in reply, submitted that though the matter is pending with the State Government, no decision has yet been communicated.

6. In such circumstance, this application is disposed of with a direction to the Director, Primary Education, to take a final decision on the claim of the petitioner for taking over of the said School within two months from the date the petitioner files a fresh representation in this regard, along with a copy of this order and communicate the said decision thereafter.

7. This application stands disposed of.
