JUSTICE P. B. BAJANTHRI) 05-04-2023 In the instant petition, petitioner has prayed for the following relief(s):- "1. (A) A writ in the nature of CERTIORARI or any other appropriate writ/s, order/s direction/s for quashing the tender issued with the signature of District Magistrate, Nalanda as published in Prabhat Khabar, Hindi Daily Newspaper published from Patna in its edition dated 18.07.2018 for supply of electricity by supplying of generator on rent for the work already covered by the work order issued by the District Magistrate, Nalanda i.e. Annexure - 2 to this petition.
(Annexure - 4) (B) A writ in the nature of MANDAMUS or any other appropriate writ/s, order/s direction/s for commanding and directing the Respondent Authorities:- i. To allow the Petitioner to complete the work as stipulated in the work order dated 12.07.2017 as contained in Memo No.
Patna High Court CWJC No.14788 of 2018(6) dt.05-04-2023 2/2 and terms stipulated in the work order. (Annexure - 2) ii. To pay to the Petitioner his entire dues with interest for the work already done since the work order i.e. June 2017.
iii. To restrain the Respondents from giving effect to the new tender as issued by the District Magistrate, Nalanda for supply Electricity to 20 Anchal of Nalanda District as published in the "Prabhat Khabar" a Hindi Newspaper published from Patna in the edition dated 18.07.2018.
(Annexure - 4) (C) To any other relief/s to which the petitioner is found entitled to."
Due to lapse of time, learned counsel for the petitioner on instruction submitted that petitioner will be satisfied if all dues are settled with reference to work he had executed with reference to earlier tender. In this regard, petitioner is at liberty to submit a detailed representation while furnishing details of the works executed by him and also to what extent amount is due to him. If such representation is submitted, the concerned authority is hereby directed to examine it in accordance with law and proceed to pass a detailed order to the extent whether petitioner is entitled to any dues or not within 3 months thereafter. If he is found entitled, the same shall be disbursed.
